Terms of Use for Alpen Bikepark Schneeberg (Kopie 2)

Online Shop GTC

Online Shop of Schneeberg Sesselbahn GmbH

1. Scope

The following General Terms and Conditions (GTC) apply to the online shop of Schneeberg Sesselbahn GmbH (hereinafter referred to as "SSB"). Services in the online shop are offered exclusively on the basis of these GTC. They apply in addition to the GTC and transport conditions of SSB, which are available online at www.schneebergsesselbahn.at and www.alpen-bikepark.at and are accessible at the ticket counter, and form part of all transport and usage contracts between SSB and persons making bookings in the online shop of Schneeberg Sesselbahn GmbH.

Responsible seller: Schneeberg Sesselbahn GmbH
Bahnhofplatz 1
2734 Puchberg am Schneeberg
VAT No. ATU61407748
Email: schneebergsesselbahn@niederoesterreichbahnen.at
Phone: +43 (0)2636 3661

2. Subject Matter of the Contract

The subject matter of the contract is the electronic sale of access authorisations to be stored on data carriers (KeyCards, KeyTix, Mobile Flow Tickets, barcode or QR code tickets, and PDF tickets) for use of the Schneeberg Sesselbahn and the Alpen Bikepark in Puchberg am Schneeberg.

3. Ticket Purchase

Depending on whether the customer already holds a Skidata KeyCard at the time of purchase, tickets can be purchased in two different ways:

3.1. A Skidata KeyCard (functional data carrier) is available:

Every KeyCard is assigned a uniquely identifiable serial number (e.g. 01-1614 71332500 3445 8000-01). This number must be entered during the ordering process in the online shop in order to load the desired service onto the KeyCard. The authorisation is loaded onto the KeyCard upon first use at an access reader. Customers are solely responsible for the correct entry of data, in particular the serial number on the Skidata KeyCard, and acknowledge that in the event of incorrect entry, the loading process onto the Skidata KeyCard cannot be completed.

Customers further acknowledge that when loading an existing KeyCard via internet or other data connections, occasional issues may arise. No legal consequences can be derived from this, provided that access to SSB's services can be ensured by other means.

Warranty for defects arising during the activation of a functional data carrier following a properly completed booking is provided solely by means of a further loading attempt on-site by SSB staff or by issuing an alternative valid access authorisation. If the data carrier is not functional, the user may need to purchase a new data carrier. If the booking process was incorrect solely due to the entry of incorrect or incomplete serial numbers, it may be possible to correct the booking with the assistance of SSB staff, or an alternative access authorisation may be issued. In all cases of complaint, the booking confirmation must be presented, as otherwise warranty claims or the free reissuance of an access authorisation may be refused.

3.2. A Skidata KeyCard (functional data carrier) is not available:

In this case, upon successful booking of a service, a PDF file containing a barcode (barcode or QR code) will be generated. For purely "hiking tickets" or other single journeys, for example, access at the turnstile can be obtained directly using this PDF file. Services requiring multiple passes through the turnstile will be loaded onto physical data carriers. In this case, the customer will also receive a QR code for collecting the physical data carrier on-site. Whether the service selected in the online shop can be used directly with the PDF ticket or whether collection of a physical data carrier at the ticket counter on-site is required (pick-up function) will be indicated to customers during the ordering process.

The QR code (pick-up function) as well as the KeyTix received or the loaded KeyCard must be stored carefully to prevent misuse by third parties.

3.3. Additional Information

Tickets are personal and non-transferable. Season passes and multi-day tickets of 5 days or more will additionally bear a photo of the user. In the event of misuse, SSB reserves the right to block the card for the remainder of the season without reimbursement.

3.4. Adding a Parking Space

When purchasing tickets online, a parking space at the Schneeberg Sesselbahn GmbH car park in Losenheim can be added free of charge. The vehicle registration number must be entered in the system during the online booking process. After successful booking, parking is free of charge during the period indicated on the ticket; a separate parking ticket does not need to be obtained on-site. If the vehicle registration number is entered incorrectly, the vehicle cannot be matched to the booked ticket on-site, meaning a regular parking ticket must be purchased to avoid a parking fine.

4. Booking Process

Before completing the order, customers must read and familiarise themselves with the key information regarding the relevant service or product. The customer is responsible for the accuracy of all data provided during the ordering process.

Clicking the "Order with obligation to pay" button in the online shop constitutes the customer's offer to SSB to conclude a purchase contract for digital tickets, a so-called "e-ticketing contract". Customers acknowledge that this action cannot be reversed, without prejudice to the provisions of point 6 ("Right of withdrawal").

SSB accepts the offer by sending a confirmation email following successful completion of the payment process.

Delivery is therefore deemed to take place upon receipt of the booking confirmation, which is sent exclusively by email. Customers must carry the booking confirmation in full and in a clearly legible form (e.g. as a printout or on a smartphone) throughout their visit and be able to present it upon request.

Customers may also register and log in using their social media account (Facebook or Google). When logging in via Facebook or Google, the corresponding login credentials for the account can be used. Personal data can be changed at any time after logging in under "My Account".

An incomplete or invalid order may occur in the following cases:

  • The customer has not received an email with an acknowledgement of receipt or booking confirmation
  • The payment process was cancelled for various reasons and therefore failed
  • The payment is incorrect or incomplete, meaning the required amount was not debited from the account.

In these cases, the provisional reservation will be cancelled after a short period; the purchase is therefore invalid.

5. Payment Process

The online shop uses the payment solution provided by Hobex. Customers can make payments either by credit card or via online banking. No third party is granted access to personal data or debit and credit card numbers. Hobex uses Secure Socket Layer (SSL) for the transmission of personal information. SSL creates a secure (encrypted) data connection between the customer's computer and Hobex. This ensures secure data transmission and prevents unauthorised access. After successful online payment, users will receive a payment receipt by email. This receipt contains the purchase details and must be carried along with the booking confirmation (see point 4).

6. Refund / Right of Withdrawal

Where the customer is a consumer, the provisions of the Distance and Off-Premises Contracts Act (FAGG) apply in principle; however, pursuant to § 18 para. 1 no. 10 FAGG, customers do not have the right to withdraw from the purchase with discharging effect.

This is without prejudice to the provisions on ticket refunds pursuant to points 5.4 and 5.6 of the General Terms and Conditions of Schneeberg Sesselbahn GmbH, which are available online at www.schneebergsesselbahn.at and www.alpen-bikepark.at and are accessible at the ticket counter.

If a ticket is not redeemed on the booked date, customers are entitled neither to rebooking nor to reimbursement of the ticket price. SSB is also entitled to cancel orders and bookings at any time if users violate or attempt to circumvent the contractual terms. In the case of minor violations, SSB must first request compliance from the customer on one occasion. In such cases, cancellation is only possible in the event of a further breach. The intentional entry of incorrect data is in any case not considered a minor violation.

By purchasing a ticket, customers accept the applicable transport conditions and tariff provisions of SSB.

Certain discounts, such as the NÖ-Card or the regional guest pass, cannot be applied when purchasing a ticket in the online shop. To make use of these, it is recommended to purchase the ticket on-site at the ticket counter.

7. Data Protection

The processing of personal data is carried out in compliance with the applicable data protection regulations (in particular the GDPR and the DSG). The associated data processing is necessary for the performance of the contract and is carried out in accordance with Article 6(1)(b) GDPR.

Payment data is processed for the purposes set out in Directive 2015/2366 (EU) and subsequent amendments relating to payment services in the European internal market (PSD2).
