1. Subject Matter of the Contract
1.1 The following car parks belong to Schneeberg Sesselbahn GmbH (hereinafter referred to as "SSB"):
- Family Ski Park car park (Losenheimer Straße 87, 2734 Puchberg am Schneeberg)
- Schneeberg Sesselbahn car park (Losenheimer Straße 103, 2734 Puchberg am Schneeberg)
1.2 Use of all parking areas referred to in point 1.1 is only permitted upon conclusion of a usage contract. This contract is concluded exclusively between SSB and the users of the car park, subject to compliance with the parking regulations in the version applicable at the time of parking.
1.3 The usage contract is concluded either by entering the vehicle registration number when purchasing a ticket in the online shop, or by purchasing a parking ticket at the ticket machine on-site at the Schneeberg Sesselbahn car park; a parking ticket must be purchased for each use of the car park.
Upon conclusion of the usage contract, customers acquire the right to park a roadworthy, operationally safe, and officially registered motor vehicle in a free and suitable parking space for the duration of the parking ticket's validity.
1.4 For each ticket booked in the online shop, the registration number of a vehicle may be provided, entitling that vehicle to park free of charge during the period indicated on the ticket. Customers are solely responsible for the correct entry of vehicle registration numbers. If the registration number is entered incorrectly, or if a vehicle other than the one specified at the time of ticket purchase is used, the vehicle cannot be matched to the booked ticket on-site. In such cases, a regular parking ticket must be purchased on-site to avoid a parking fine.
1.5 The purchase of SSB season or annual passes, which cannot be obtained via the online shop, also entitles the holder to use the car park free of charge during the respective period of validity.
1.6 The guarding and safekeeping of the motor vehicle, its accessories, and any items inside the vehicle do not form part of the contract.
2. Terms of Use
2.1 The provisions of the Road Traffic Act (StVO 1960) in its currently applicable version apply in SSB's car parks. Walking pace is the maximum permitted speed.
2.2 Motor vehicles may only be parked in the car park with a valid and lawfully obtained parking ticket. If the ticket is purchased on-site at the ticket machine, it must be placed clearly visible behind the windscreen. Any use of parking spaces not expressly authorised by SSB is legally invalid and therefore not permitted (see point 6.1).
2.3 The applicable tariff and any other fees can be found on the information boards on-site; parking fees must be paid at the start of the parking period.
2.4 Holders of a valid and activated Niederösterreich-CARD may obtain one free parking ticket per Niederösterreich-Card season (1 April to 31 March of the following year) by scanning the card at the parking machine.
2.5 Leaving a vehicle parked continuously for longer than the period indicated on the relevant (parking) ticket (e.g. for several days) is not permitted.
2.6 Designated disabled parking spaces may only be used by persons with disabilities holding a valid disabled person's pass pursuant to § 29b StVO, which must be displayed clearly in the vehicle.
2.7 SSB provides charging infrastructure for electric vehicles. Designated electric vehicle parking spaces may only be used by electric vehicles during the charging process. Users are liable for any damage caused to the charging infrastructure through their use. Any such damage must be reported to SSB immediately; failure to do so may result in legal consequences.
3. Parking the Vehicle
3.1 Vehicles must be parked in a manner that does not obstruct third parties or make unauthorised use of spaces designated for other purposes, such as disabled parking spaces, the mountain rescue car park, or other reserved spaces (e.g. electric vehicle spaces, specially marked zones). Parking in contravention of traffic regulations is also prohibited.
3.2 In the event that a vehicle is parked in contravention of the provisions of these parking regulations – in particular where towing under the StVO would be justified – or where the permitted parking period is exceeded, SSB is entitled to take legal action against the responsible registered owner. The costs incurred thereby will be charged to the registered owner.
4. Rules of Conduct
4.1 Only roadworthy, operationally safe, and officially registered motor vehicles may be parked in the car park.
4.2 The following are expressly prohibited:
- the use of fire or open flames
- the placing or storage of objects of any kind, in particular flammable and explosive materials
- carrying out maintenance, care, cleaning, or repair work, including in particular refuelling vehicles and draining coolant
- leaving the engine running for extended periods
- parking a vehicle with a leaking operating system (in particular where fuel, oil, or other fluids are leaking) or other safety-relevant defects
- parking in a manner that obstructs traffic, e.g. on traffic lanes, on pedestrian walkways, in front of doors (gates) and exits, within the operating range of doors and gates, etc.
- distributing advertising materials without prior written consent from SSB
- obstructing snow clearance or gritting operations with parked vehicles
4.3 SSB staff may issue additional instructions at any time. These instructions must be followed without exception.
5. Liability
5.1 Use of the car park is at the user's own risk. SSB accepts no liability for the conduct of third parties, theft, or break-ins. SSB is only liable for damage to a motor vehicle if such damage was caused intentionally or through gross negligence by SSB or its employees.
5.2 SSB is furthermore not liable for damage caused directly or indirectly by force majeure to a parked motor vehicle.
5.3 Users undertake to properly secure and lock their parked motor vehicle.
6. Parking Without a Parking Ticket and Procedure in the Event of Violations
6.1 Parking a vehicle without a valid and lawfully obtained parking ticket constitutes a disturbance of possession. In such cases, SSB is entitled to have the vehicle removed or towed at the owner's expense. SSB further reserves the right to charge a penalty fee (administrative fee for documenting the disturbance of possession, identifying the registered owner, and other related administrative activities). This also applies where a parked vehicle is parked in contravention of the provisions of these parking regulations.
6.2 In the event of failure to pay within the required period, collection will be pursued by a service provider and/or lawyer engaged by SSB for this purpose, and the registered owner will additionally be required to reimburse the costs incurred (in particular reminder, investigation, and legal fees) within 30 days.
6.3 SSB is entitled to take civil legal action in the event of violations of these parking regulations (action for disturbance of possession, damages claim, and/or a request for a cease-and-desist undertaking).
7. Data Protection
7.1 The processing of personal data, including vehicle registration numbers, is carried out in compliance with the applicable data protection regulations (in particular the GDPR and the DSG). The associated data processing is necessary for the performance of the contract and is carried out in accordance with Article 6(1)(b) GDPR. In addition, in the event of unlawful use of the car park (e.g. without a valid parking ticket), further personal data will be collected and stored by the controller. This data will be deleted promptly once the purpose of the processing has been fulfilled (the controller's legitimate interest in documentation, identification, and enforcement of legal claims, in particular civil actions or defence against damages claims) and no statutory retention period prevents early deletion.

8. Place of Performance and Jurisdiction
For usage contracts relating to the use of car parks and all disputes arising therefrom or in connection therewith, the application of Austrian law is agreed, to the exclusion of the UN Convention on Contracts for the International Sale of Goods and the conflict-of-law rules of private international law.
